Tap attached to neighbours extension

It’s my water supply but clipped onto to neighbours side of house. This was done 18 years ago when extension on my side was built. They are just saying nothing can be attached there so remove. Gap between house is about 10 cm guess. I would happily just remove tap but the rest is so annoying to do.

What is the plan for removing the "rest" of it?

What are they threatening to do if you don't remove it all?

Is it possible that you have gained some rights over the past 18 years? I don't know the answer. Just flagging it as a possibility.

The threat that have received via email. Is that if if not removed in 7 days he will come onto my property and remove and that I will have to pay to make good.

It sounds like your sister has a plan for removing it all. What was that plan?
 
It does look odd but it wouldn't bother me, some neighbor's are our soles.

It seems to me that permission for the pipe was granted eighteen years ago by the previous owner.

Maybe that creates some sort of legal right. Perhaps an easement of some sort. Not my area.

I would just get a plumber to move it, it's not worth the hassle.

But the OP seems to be saying that isn't possible. Although, it is a bit like trying to get blood from a stone!
 
If you disconnect it you are no longer trespassing. He won’t get an injunction or significant damages, so will have to give up. Most solicitors would laugh at this.

I’d be more concerned that he or you may have built over the boundary, assuming the fence is correctly positioned. Is it flat roof?

I can see why he doesn’t want it there. But it seems to be a party wall and you appear to have had exclusive possession for at least the last 18 years.

You should not acknowledge any responsibility and any agreement to do anything should be a without prejudice gesture of good will
 
I think my main problem is him saying get it done in 7 days. I can’t actually get done in this time frame. My sister is a plumber and explained what would need to be done. My issue is neighbour coming onto my property and removing tap.
I would politely email him and say: “I have booked a plumber to remove the garden tap, unfortunately she cannot come within 7 days but will do it on xyz day.”

If he responds “It’s got to be done within 7 days” just very politely explain you can’t get a plumber within that timeframe.

If he threatens to trespass and remove it, leaving water rushing out, very politely explain he will be liable for damages. It would be rather fortuitous if his garden is a bit lower than yours……as all the water will end up flooding his garden.


He is trying to create situations that are impossible like short time period, like wanting clips that can’t be reached removed…….just ignore them, keep politely offering to do what is fair and reasonable.


I hope the loft extension and any other work he has had done complies fully with planning and building regs…….if it was me I’d be checking, I once had a client threaten to take me to court, but they forgot they had converted a stable block into an apartment with kitchen, bedroom etc, but they never got planning for it, I reminded them.
 
I wouldn’t send any emails.

Trespassing, removing it and leaving water gushing would be criminal damage assuming you haven’t granted him any rights or acknowledged any liability.

It is a flat roof. I have actually wondered if the their extension is over bondary because over the line of fence and actually trying to look on deeds but don’t seem exact. So if I remove tap and leave some of piping. Isolate tap from inside so no long functioning that would be ok?
