This makes no sense:

Fair enough to oppose something if an attempt is being made to make you do it, but why waste time and money fighting against other people spending their time and money to find out if you're allowed to do something you have absolutely no intention of doing?

A court saying "You may do X if you want" is in no way saying "You must do X whether you want to or not".
 
Because is sits there as a possible argument/option even though currently nobody is looking at it.

Hiding possible alternatives is a way of tricking or forcing people to accept your choice.

For example:

Which is it to be? Holiday in Swansea or no holiday?

What about holiday in Torremolinos?

Not possible, I have no passport. The only alternatives are holiday in Swansea or no holiday.

But you could get a passport.

No I couldn't, I have no photo. The only alternatives are holiday in Swansea or no holiday.

But you could get a photo

Not possible, there is no photo booth in this town. The only alternatives are Swansea, or no holiday.
