Vote Leave broke the Law

Unless you live in a cave you would have probably heard by now that the Vote Leave Campaign have broken the law on election finances and those whistle blowers who had their reputation and character questioned can now demand an apology from their accusers.

But on the issue of the referendum it cannot be challenged legally.

Essentially it was a political instrument so only the politicians can decide what to do.

The referendum was advisory in nature so it is upto the government to decide what is in the best interests of the nation.

As an aside

Venice Code of Good Practice (2006)
Their Code of Good Practice on Referendums states under clause 3.3. on referendum funding:

“National rules on both public and private funding of political parties and election campaigns must be applicable to referendum campaigns.

“As in the case of elections, funding must be transparent, particularly when it comes to campaign accounts.

“In the event of a failure to abide by the statutory requirements, for instance if the cap on spending is exceeded by a significant margin, the vote must be annulled.

“It should be pointed out that the principle of equality of opportunity applies to public funding; equality should be ensured between a proposal’s supporters and opponents.”

The Code, however, is a guide only, and not legally binding.

yes - as per the other thread. We had a general election on the back of the Brexit vote and a party formed a govt on a pledge to deliver Brexit. it was only the lib-dems and SNP who said no to Brexit and neither had anything like enough MPs. The referendum invalid or otherwise is history.

Unfortunately the EC is limited to the size of the fines it can hand out and is asking for more powers in the future.

It was UK electoral law that was broken!

But what's funny is the retort from the guilty campaign - Vote Leave said the "wholly inaccurate" report was politically motivated.

They should know all about "wholly inaccurate" !
