Why is my worchester boss firing when 2 degrees above set temp?

Question one has to be, is this a fault? My parent's thermostat,

was designed to stop hysteresis, and so before the target it would start a mark/space ratio, turning the heating off, and on, slowly increasing the off time, and this would continue after the target as well.

Today we would not use that thermostat, as it would mess up a modern modulating boiler. It was designed when boilers simply turned on/off.

But we still see some 'smart' ideas, and some simply don't work, I am sure they would work in some homes, but I fitted Nest Gen 3 learning thermostat, which was designed it seems to remember what you have done, and build a schedule to do as you want. One could view the schedule, and in my house it was crazy, likely because sometimes doors closed and other times left open.

There was an option to disable the 'smart' features, and one by one, all have been disabled.
