More evidence the law is an ass

It was Liverpool not London. Parents can't imprison their kids or watch them 24/7. This might have been the first time this kid was allowed out at night for all we know. It's irrelevant anyway, if the guard had done what he was there to do she'd still be alive.
 
How many of you hypocrites if driving a train , bus, van, lorry etc and had vision of someone standing like that depicted in the image would actually not let the clutch out just when you need to drive off?

I certainly wouldn't. Though if I seen the person fall to the side of the vehicle I'd obviously slam the brakes on.

OK. Wrong city, shows how often I watch the news!!

But at the same time, my daughter, when 16, went out with her mates.

She was well aware in no uncertain terms that if she came home langered and spewed/ didn't get home there would be consequences.

Consequences, no beatings etc. etc.. I think it used to be called respect.

How many drivers have you ever seen jailed who had vision of people leaning on their vehicle just as they move off and then stop when an accident occurs?

If an ee hangs unto a hgv at calais port and the driver doesn't see him/her and is run over then only one person is to blame and its not the driver.

WTF has this got to do with an ar$ehole of a train guard ignoring safety guidelines and causing the death of a girl WHO HE SAW WAS NOT AT A SAFE DISTANCE? Also, WTF has this got to do with the scenario about releasing your clutch getting ready to move off with someone YOU ARE FULLY AWARE OF leaning on your vehicle?

Nope. Parent gets it wrong by letting her young daughter run the streets drunk and on drugs. She is culpable by 50%.

Victim gets it wrong by getting drunk and high on drugs and then leans on a dangerous vehicle. She is 30% culpable.
Guard plays a minor role and is 20% culpable.

The only people needing jailing here are the mother and daughter.

EE hangs on beneath a lorry without the drivers knowledge. Driver releases clutch and ee falls off getting crushed.

EE is 100% culpable and any damage to the lorry should be paid for from his estate.
 
Guard had one and only one thing to check before he told the driver that it was safe to leave. He saw that the girl was still too close to the train and decided to ignore this information, in spite of his training and guidelines. He thus killed her through wilful neglect. The state she was in is of no relevance - the guard would have done exactly the same if she was stone cold sober and an adult.

Driver with ee on underside if vehicle is unaware of potential danger and is therefore not culpable.

Of course it's relevant.

Had she not been off her nut she may well still be alive today.
?the guard has shown that he was quite prepared to ignore somebody's safety. Her state is not relevant when considering his innocence or guilt.

If he had done his job properly she would probably still be alive today.
