Building Regs for Timber Garage

Hello, I wonder if you can help me.

I live in South Gloucestershire and am looking to erect a timber garage to the south side of my property, it will be between 15 and 30 square metres.

I understand planning permission is not required as long as the building is more than 1 metre from my boundary and under a height of 2.5 metres.

My boundary line according to the land registry is approximately 5.5 metres south from the side of my house, this boundary line runs through a hedgerow and trees. There is no other property to the other side of the hedgerow. The house builder in 1994 put up a fence which runs along the side of the house but obviously they could not place the fence tight up against the hedgerow/trees, therefore the fence is approximately 1.75 metres from the tree trunks. This is evident on the land registry plan which shows that I own the land that runs past the fence line into the hedgerow/trees.

I have emails from South Glos Community spaces Officer and the house builder that the hedgerow is my property and that the fencing erected was only intended as a temporary measure to protect the hedgerow/trees during the house construction.

The position of the proposed timber garage will be more than 1 metre from the true boundary as shown on the registry, but I would like to know if I can move the fence line which is currently at approximately 3.75 metres from the house to nearer 4.25 metres?

This would result in the fence line and timber garage being approximately 1.25 metres from the boundary.

Is it possible to move the fence line as detailed above, alternatively that I can place the timber garage right up to the existing fence line which is at 3.75 metres but still 1.75 metres from the actual boundary line.

You may be confusing Planning and Building Regulations. There are other conditions which have to be satisfied for it not to require planning permission.

Thanks, you right it is the regs that I'm trying to clarify. I've gone through the portal and planning permission is fine based upon the size and position, but I have to consider regs as the timber garage will be near the fence but not the boundary.

This brings me back to the distance to the boundary which would be more than 1 metre but I would need to move the fence out by 500mm.

Assuming it's just Building Regs you are concerned about - as long as it is a) under 30 sq.m. and b) at least 1m from a boundary, Building Regs will not be applicable (except for electrics).

The position of a fence doesn't matter - it's the boundary that counts.
 
With regards to the regs and the proximity of the boundary, the limitations are for the spread of flame to adjacent property (even if no adjacent property currently exists).

Another option of course is to finish the building in non - combustible materials. If weatherboard is used as a finish, then use a fibre cement product instead (eternit or hardy).
