I live in South Gloucestershire and am looking to erect a timber garage to the south side of my property, it will be between 15 and 30 square metres.
I understand planning permission is not required as long as the building is more than 1 metre from my boundary and under a height of 2.5 metres.
My boundary line according to the land registry is approximately 5.5 metres south from the side of my house, this boundary line runs through a hedgerow and trees. There is no other property to the other side of the hedgerow. The house builder in 1994 put up a fence which runs along the side of the house but obviously they could not place the fence tight up against the hedgerow/trees, therefore the fence is approximately 1.75 metres from the tree trunks. This is evident on the land registry plan which shows that I own the land that runs past the fence line into the hedgerow/trees.
I have emails from South Glos Community spaces Officer and the house builder that the hedgerow is my property and that the fencing erected was only intended as a temporary measure to protect the hedgerow/trees during the house construction.
The position of the proposed timber garage will be more than 1 metre from the true boundary as shown on the registry, but I would like to know if I can move the fence line which is currently at approximately 3.75 metres from the house to nearer 4.25 metres?
This would result in the fence line and timber garage being approximately 1.25 metres from the boundary.
Is it possible to move the fence line as detailed above, alternatively that I can place the timber garage right up to the existing fence line which is at 3.75 metres but still 1.75 metres from the actual boundary line.
