But that is the only part I am actually interested in. I had interpreted your initial post to be saying that we couldn't deport those with an open asylum claim because it would be against the ECHR. If that isn't what you were saying, then just please confirm, so that we can stop.
Then I suggest you familiarise yourself with the case law. Do you need a link?

Speaks volumes about what? Are you criticising me for having different interests to you. I am looking at the big picture of what we can achieve within our existing laws and which laws might need changing.

I think there has been a change under Labour, though. I tried to get to the bottom of it a couple of weeks ago. I think under the Tories, the boat people still claimed asylum. It is just that they were automatically disqualified from being granted asylum. And I think straight after the election, Yvette Cooper passed some sort of regulation to change that. But without actually repealing the Illegal Migration Act. So, I believe the boat people can now be granted asylum.

Anyone taking a quick glance at the treaty can see the massive loopholes

It will be interesting to see how Labour get round the human rights act when forcibly deporting people back to france who have open asylum claims.

I only referred to the HRA and the treaty gets around it by excluding anyone with a claim. So my interest is satisfied. You seem to have strange views about both and the case law is something you should read given your interest.

There will be no deportation of anyone with an open claim or anyone who has been in the U.K. for more than 2 weeks based on the treaty.

It’s difficult to see who might actually be eligible for return given 90-95% of arrivals immediately claim asylum. Anyone left might claim to be under 18 and while that is being investigated, the clock is ticking.
