If the crew of the yacht were all below deck the Russian ship would be blind to them, as the Russians tried to make contact on the radio with no response as well as sounding their horn then the only way then to catch their attention was to fire warning shots in order to grab its attention. The sailing boat disputes that they were hailed on VHF not that it makes much difference. They also claim it was foggy.

Having seen some photos of the boat, you can clearly see the Raymarine radar pod about half way up the mast.

From what i've read, the skipper and crew were playing the 'steam gives way to sail' card and expected the Russian warship to change course.
