When you agree to take on a service from a company, it comes with a whole sheet of T's & C's.

You agree this, you agree that, you agree the other. The company this, the company that, the company the other.

What if: supply of that product for some reason is interrupted and the company cannot restart it?

What if: they appear incompetent? Offering the same (futile) suggestions every time you ring to complain about no service?

You must have a get-out clause.

Would a judge see sense if, in the above case, you cancelled your DD paying for the "service"?

The company then took you to court for non-payment.

You presented your diary to the judge explaining your failed attempts to contact the company and rectify the issue.

You need proof with time/dates etc. A diary is not prooof.

If you can prove you have contacted them with complaints along with dates and prove the service was substandard then you may have a chance.

Well, maybe a video diary then. But you get the idea.

Companies surely cannot keep holding you to a contract when then persistently fail to supply the goods.
 
Their are breach of contract rules, of course, but you need to be able to prove it.
 
always ask for the name of the person your speaking to(something my missus forgets to do)ans as most companys say 'this conversation is being recorded' ask for a copy or tell them your recording it yourself.
 
there is no mention off what it is but i assume we are talking mobile phone
the trouble you have it a service that they supply and will give you the coverage figures and the likely coverage but not the actual
because its a mobile service specific bad spots are expected so will be in the contract
i personally think you should be able to try for say 4 weeks before you are penalized for termination but at present its in the providers favour
 
One way ofproof is an itemised phone bill showing date, time and call duration.
Also, if they do record calls you have the right to ask them to check your calls, (so long as you can give them an approximate date of the calls involved), however, I'm not sure if you can demand copies. If it goes to court your solicitor will be able to claim copies of recorded calls though.

If you write to them make sure you keep copies of your letters, preferably date stamped at the post office so they can't sy you wrote them at a later date, and any you do send should be by recorded delivery.

Yes of course you have redress under the consumer rights act (1973?) if the goods or services are not of an acceptable quality (bit of a grey area here) you have the right of replacement or refund.
 
I know it's not the point, but I am with talk talk and I have found rebooting the router seems to fix it.
