decking planning permission

We had decking installed in 2006-2007. I was reading today that all decking built after oct08 needs planning permission if the deckin is over 1ft from the ground. Ours is above this height but was installed before oct08 but have no proof it was before this time.
Will we still need 2 apply for planning permission??

This begs the question what exactly you are worried about? Do you have neighbours close by you think may mention it to planning?

BTW any development older than 4 years old is immune from any prosecution. Any dated digital photos to hand?

I wasnt so worried about it, more curious. Just accidently stumbled on a article about decking over certain height/size needing planning permission so just wondered about it, incase a problem arises in the future.
But since had no complaints from neighbours n decking has been there for a long time there should be no problems :) and the neighbours should be able to verify its been there before the changes 2 planning came into effect.

The onus would be on the LPA to prove that the work needed PP or was not PD or whatever, and not for you to prove that it was done at a certain time, and so did not need it or was PD

Basically you say it was done on X date and that is it. Obviously, if it is brand spanking new and clearly not a few years old, then that would be a bit different

or recipes or videos like the barbecue on completion 2007

also remember its from the natural ground level covered by the decking
as in it can be higher if the ground slopes as long as its less than 300mm at the grounds highest point
