I missed that bit too. I found a bit that says the backstop will kick in if the EU fails to approve an alternative, is that the bit you mean?, that's a very different meaning to your suggestion and effectively has us over a barrel, that's why we're not buying it.

According to the EU the silly moo Theresa Mays WA is a done deal even though it was never ratified by the UK parliament.
Boris has said it should be reopened in order that negotiations can continue in order to make it acceptable to the UK parliament, the EU says no further negotiations will take place.
The backstop is a solution to a problem that doesn't exist.
