You would need to watch the CCTV footage for yourself, but if the two quotes are true to the footage, can't really see much of a defence.

If such guards cannot be held to account for failing to do their job, what's the point in having them?

Many people stay close to a train window /door waving off their relatives despite being warned to "mind the gap"
The Guard would not have known she was drunk /incapable and under the influence of drugs, so much so she was unable to stand and leaned forward at the same time he waved the train on.
Going by this picture she just seems to be banging on the train window,

But the quotes do not suggest that, she was already leaning on it.

I don't think the fact she was drunk is relevant.
 
What is relevant is the lack of Platform Staff, who should have been there to ensure passengers were well away from the safety line, and safe onward transit of the train.

Platform staff? What platform staff? MerseyRail stations all run on pretty miniscule staffing levels from what I've seen

I think ticket prices are high enough thank you.

Well if it means making them higher to pay for 'platform staff' they raise then raise the prices.

Guards never did platform duty until they made cutbacks.
 
So its really down to the Shareholders making a profit than ensuring they have adequate platform staff to ensure the safety of the pssengers,

So the Train Guard is just another "Scapegoat" to take the blame when things go wrong.

Course he was well aware of her condition, he moved her away from the train once before.

It was a tragic accident caused by a number of factors, to jail a man for 5 years was the wrong decision in my opinion, and the opinion of thousands more.

You can clearly see ONE person on the platform, not many, not a few, ONE person leaning on the train.

His entire reason for employment is to make sure people are back before giving the all clear, her state doesn't enter into it, she could have been sober or drunk, she was leaning on the train.

negligence, bang to rights.




If you can't hold him up for it, then you might as well sack the lot of them, after all, what's the point in having them if they can just give the all clear, and no matter what, get away with it.




Her punishment for her stupidity was death, her mothers punishment is a life of guilt (you really think that because she shouts about it being the drivers fault, she hasn't got a niggling voice).
