New installation of gas boiler

Could someone confirm what action should be taken regarding the following incident?

If a Gas Safe Registered installer fits a new heating system, commissions the gas boiler, issues a CP12 and registers the gas boiler with Gas Safe Register (Building Compliance Certificate) and at a later service date the gas boiler flue was found not to have been sealed, leaving a gaping hole around the external boiler flue, what risk would this be classed as?

My opinion is that it should be ‘at risk’ but should a Riddor report be made due to an incorrect installation?

and if so for what reason?

This is just a general question and not a real incident

Boiler makers accept the rubber gasket.

Gas Safe expect it to be cemented ( except for a grey area of tall buildings ).

GS probably class it as At Risk if only the rubber is used.

It is good practice to cement it as it could allow water to enter the brickwork.

GS do not accept expanding foam as suitable ( even if its the high temp type ).

You should ask the installer to cement it. Whilst he may have filled in the paperwork, not cementing is an example of slap dash work in my view.
