technical theft?

my parents bought some tiles today for the bathroom..
they paid £80 for 16m² of tiles.. ( only needed 15m² but the tile guy said an extra one in case.. )

so I went to fetch them and the guy loaded up my van with 17 boxes of tiles...

for a start there is an extra box to what they asked for, and it turns out that each box contains 30pcs 200 x 250 tiles.. so 1.5m² per box..
so they have been given 25.5m² when they only paid for 16m²

is this technically theft as they didn'tmake the mistake the guy at the tile place did.. ( was the same guy sold them as loaded them so it's not like it was a mis-comunication thing.. )

Obviously the lame-brain thought there was just a square metre in each box.

If you hadn't got the calculator out, the surplus would only have shown up on completion of the job.

Solution. Either
a) finish the job and return the unused boxes for a refund. ;)
b) Knock together a quick ensuite bathroom and use the surplus tiles. :evil:

the surplus tiles might be destined for my kitchen yet.. if there's enough left over to do the backsplash on 3 walls.. should be at 10m² left over..

it's just the lagality of it that I'm "worried" about..

Technically as you already know they are not yours and they haven't been paid for you are already commiting an offence.

It would be a difficult case to prove though as you just picked up what they gave you.

Use them on another job.

If they do come back to you/your parents just plead ignorance.
 
they could always take the excess back and get a refund.. ( he said if there's any boxes left over they's take them back.. thinking that the extra box he talked them into might not be needed.. )

if they make sure it's a different guy they could get a refund of £45.. ( £5/m² ).. 9m² ( 6 full boxes ) left over...

They could have a night out on the tiles.
 
Couple of years ago my wife bought 11 boxes of tiles.
God only knows how but the cashier rang up £7 for one box and didn't spot the other 10 boxes next to it in the trolley. Wife was talking to her mate at the time and just signed the debit card slip, (before C&P), walked out the shop and an asistant kindly loaded them into the car for her.

Realised the mistake that night and i said, "Sod them, about time we got a freebie off them they get enough business off us."

2 weeks later, tiling finished and got 3 boxes over. I took them back, said I'd lost my receipt and got a credit note for £25.50, they'd gone up to £8.50 a box! :LOL: :LOL:

Still shop there to this day. :LOL:

Would they spend even a second seeking you out had they made some sort of error in 'their' favour? I'm inclined to think not.
 
out and out theft as you are fully aware off the mistake :D :D

my suggestion is to make them aware off there mistake and ask what they intend to do!!
if they say they will pick them up and you want them just ask how much they would want for them and if you agree say you will drop the money in at a later date or pay over the phone with your switch or credit card

they may even say keep them as its not worth the hassle then you are in the clear

as for taking back anything you haven't paid for to get a refund isn't that one off the things that shoplifters get locked up for :cry: :cry:

Over this, I ain't got one.

I have given them thousands of pounds worth of business over the past 30 years or so. Its not one of the BIG ones but is quite large and the family all drive new cars every year.

common practice buying extra, and for someone who regulary posts in the tile forum im astonished you even question this

not very often it happens, you should smile and use them as you wish, however i wouldnt take them back for a refund, thats just taking the pee
