Parking "ticket" from elite management ( midlands

I stopped on a car park that was, last time I looked, for the use of customers to the cafe, pub and other shops that back onto it.

it now seems that it's a private car park and you need a permit to park on there.

there was no sign on the wall the direction I entered and the rest of the signs are in inconspicuous places.
there is STILL a sign up saying that the car park is for patrons of the pub and shops, and is prominently sited and larger in size than the others..

as this is not a council issued parking ticket, I read that it is merely an "invoice" and is un-enforcable?

is this right as I cannot afford £90 right now for the 10 miinutes that I was in the cafe for..
the car park was completely empty and the guy must have been waiting in the shadows to issue me with a ticket and clear off so fast..

You are correct, this ticket is not enforcable at all. Just put the invoice in the draw and forget about it.

I've sent the company an e-mail saying that I won't be paying their invoice and might even be seeking a claim against them for damage to my vehicle where the sticky pouch was placed patially on the windscreen uprights ( whatever they are called ).

I told them about the sign saying that it was a car park for patrons of the shops nearby and that I did not see a single sign from the moment I entered their carpark until I left..

so as you can see.. I saw NO signs when I entered, parked, got out of my car, walked to the cafe, or when I returned to my car from the cafe..

the only sign I knew of from previous visits was the one shown..

I therefore put it to you that as I was unaware of the posted signs that were all in inconspicuous places, and therefore did not enter into any implied contract nor agree to the terms shown in them.

To be honest you shouldnt have really made contact with them. You will get the standard letter soon which is normal, rejecting your appeal. Just throw it in the bin. Ignore them

You didn't use the public house, and are not a shopkeeper? So you used the car park illegally. You got fined. You post a picture of the rules. You complain. WHY?

Why do people continually moan and complain when they broke blatent rules? Admit you are wrong, pay the fine, don't break rules!

He didn't use the car park illegally; he broke no law. The owner of the land is merely trying to frighten him into paying a fee.

It happened to a late pal of mine some years ago when he got wheelclamped on private land. He was a solicitor so he didn't take any *******s from anybody. Police wouldn't help though they did admit that they were aware of the scam and would love to find a reason to prosecute the scammers. AA wouldn't help. So he called a 24hr recovery firm who craned his car away to a garage where the mechanic dismantled the front suspension to get the wheelclamp off, undamaged. The clampers threatened all kinds of retribution but my pal told them in polite legal terms to go feck themselves and by the way they could collect their wheelclamp at any time from his shed. It is still there, 10 years later.

It cost him around £290 while the "fine" would have been £50 but as he said to me, "the difference was, I enjoyed paying that money!"

secondly I misunderstood the sign, I thought it ment it was for people using the pub or the shops in front of it.
thirdly, as you will see the sign I saw is a polite notice and makes no mention of any fees or anything else.

I can understand if it was in the middle of london and the car park was constantly packed, but at the time I parked there it was completely empty besides one other car ( which I now believe was the "parking enforcer" who was deliberately parked in front of one sign I might have possibly seen.. ).
I was there for the total time of about 7 minutes while I got a sandwhich from the cafe that fronted the car park..

You posted the sign, it is clear to see...but there is good news on the horizon; new Government policy (ie they ask the public what to do, then do it!); the new rules are that all clampers have to abide by a central code, certain fees, and time limits are to be adhered to, if it passes.

But I'm still adament, if you park your car on someone elses land, and break the rules, then fine you are clamped. I like traffic wardens. I was waiting for a bus today, and no less that 4 other vehicles were parked in the bus stop clearway (that's the official term, I have complained to the GMPTE and council about this), and the bus nearly didn't stop, as it couldn't see me, had to pull up in the carriageway, thus causing an obstruction. due to people nipping into a papershop to pick up a paper! So people that park illegally, usually do so for ignorant reasons, so when they get done, good. You broke the law.

I came home one day, and there is a busstop a few doors down from me, and the road painters had painted outside my house, nowhere near mine. So I complained to the council, and they repainted the clearway. I got two parking tickets, and they were immediately recinded by the council, as they painted the clearway illegally.

Since then, they have repainted the lines of the clearway over 4 times, and the line-out is STILL illegal.

So car drivers; abide by the law, you are putting people at risk, by your illegal parking! Parking on a pavement, using your hazards isn't an excuse to pick up a paper. Inconveniencing people by bad driving isn't an excuse, learn how to drive, the hazard warning light, isn't a get out of jail, it the best way to be fined. Have some consideration! In your little bubble.
