Problems with Marley Eternit Monarch Tiles

You could gather all your written evidence and start County Court Proceedings in the Small Claims Court. Its relatively straight forward to do and will only cost you around £150. Your local County Court (in England & Wales) will be able to assist you. The limit for a claim in the SCC is £5000. You are not liable for the other parties fees if you lose the case. Also your home/car legal advice lines are quite useful, if you have them use them.

The very real threat of Court Proceedings will focus their minds and may get the problem resolved. The closer it comes to the Court date the more likley it is you will either get the work done or an out of Court settelment with ( cant remember the legal phrase for it ) a gagging condition on you not to tell anyone the outcome so they dont get avalanced on a prescident.

I have problems too, on my own eight year old house which in a way is perhaps fortuitous given that I am an Architect. I have been fobbed off by Marley who are taking the stance that my now white (and grey mixture)roof tiles are aceptable. I am now going to expose the product problem to the national press, trade magazines, my own professional body etc. They in turn have threatened me with their solicitor.

I also am experiencing problems with my Marley Monarch roof tiles on my three holiday lodges. They sound to be the same as all yours, more white than grey. The only time they look OK is in the rain. After writing to complain, I had a visit from their Paul Newman, which was an absolute waste of time, other than he did say that they had other complaints and some were going to have some form of compensation but would not expand any further. I have since received a letter saying that the tiles are performing within the parameters of the requirements set out for the product and have closed my enquiry. Before writing back to them, has anyone managed to get any further, because I feel that we ought to join forces in making a big issue about this. Happy to have come across this forum, unhappy to have to search for it though! We to have the same problems with Marley Monarch Roof Tiles, we had our property re-roofed in 2006 and many of our tiles are now almost white. Phillip Wallis recently visited the property and he must be well trained in acting surprised! I am waiting 4 - 6 weeks for an answer to their findings? I can kinda guess what it's going to be!

I'll be keeping an eye on proceeding here, waiting on the rain to stop to allow me to send more photographs to Marley. Think I may mention to Phil that I have heard from other disgruntled home owners, hopefully it'll avoid him trying to fob me off.

I live in wales, there are about 200 houses on site that are between 5 & 8 years old they all have the same problem with the roof tiles , has anybody gone to watch dog/ ferret or x-ray about this please let me know thanks kavan

I have the same problem with Marley Marquis tiles.
I contacted them about 18 months ago and finally had someone come and look at the problem last month. I have now received a letter saying they consider the discolouration to be normal weathering which is obviously ridiculous as the roof looks like a chess board.
All the houses in our small development have the same problem. One has been re-coated and looks good 2 years on. Another did a deal and was given a percentage of new (different) tiles at no cost when they were retiling their house.
The problem has become so massive that they can't afford to deal with it. I'm expecting a long battle over this.

directed to show house Pierston Irvine to inspect.
Noted marley concrete roof tiles with colour throught
tiles with substantial eaves closures.
not allowed to inspect new house untill two days before entry.TYPE OF mARLEY ROOF TILE CHANGED.
Eighteen months after entry tiles showing white marks
thought to be efflorescence .It turned out to be faulty painted tils by marley After many months of delaying tacticts and procrastination thanking me for my patience The main contractor builder Mactaggart and Mickel, Marley eternit their supplier & N H B C insurance all confirmed no liability.
Obviously i would not have bought the house had i been told that the roof tiles had been changed to painted faulty tiles also found to be obsolete.

All clients of Mactaggart and Mickel require to form a class action to force the contractor to sort this serious problem. drawde

we built our house 5 years ago and reported the discolouration to Marley. The rep at the time said they were fully aware of the problem and that it would be resolved. it has not been. we are now taking legal proceedings against Marley and would appreciate it if anyone has a specification sheet for Marley Monarch tiles that they could forward on to us.

I also live in Argyll and have had 2 site visits by Philip Wallis, most recently in mid april when he seemed to be doing a tour of disgruntled customers in the area. My tiles are marquess, they were put on in 2005 and now about half of them have shed their dark grey surface to reveal a paler grey core.
Marley say its just weathering.
I've downloaded BS 490 today, as Marley do say that the "weathering" is permitted in the regs. The regs do state that "Under the influence of natural weathering, changes in colour and appearance may occur" but I believe the amount of colour change is unacceptable.
I'm happy to be involved in a some form of group action if anyone once to take this tack.

We are trying to clarify what Marley mean by a 'through colour tile'. We accept that on a through colour tile natural weathering may occur and that the colour may fade slightly but it does not mean that it will change from one colour to another eg from blue grey to white.

If anyone could clarify this matter for us we would greatly appreciat it.

I'm quite surprised just how many people seem to be having the same problem here but it's not just Marley who suffer this problem. There are two other fibre cement tile manufacturers in Europe who have had the same problem. We have been contracted in the past to remedy this work in the original colour "Blue Black" and the result is an as new look. The big difference is these companies put there hands up and paid for the work to be done!

We are currently in legal dispute with Jewsons and Marley regarding the Marquees Roofing Tiles.

Does anyone have a copy of BS EN 490?

We also have this problem !! The outer coating is flaking off,leaving a bare concrete tile. Unsightly and wouldn't be surprised if the bare concrete is pourous?

I've heard of a few houses in the area being re-roofed. So maybe there is hope ??

through coloured means the product is made from a mix -of whatever- that is coloured early in the process of manufacture - rather than given a coat of colour later

Hi all,

I was wondering how people had got on with the dealing with Marley since the last post? We had the usual letter off them yesterday dismissing it down to weathering and I'm very determined to not let Marley get away with it!
