Article 16 is a mechanism that can be invoked by EU or by UK, If the action of the Protocol creates difficulties.Article 16 is a mechanism which can be invoked unilaterally by the UK if the EU start playing silly buggers with their "border".
EU hasn't banned crisps. They may have insisted on proper procedures for importing crisps from Britain into NI, but it's not EU's fault if UK has not been able to implement those checks and procedures through their own inadequacies.If i go to Tescos and i can't get my favourite crisps because the EU has banned them, then that could be classified as societal damage, this could then be a valid reason to invoke article 16.
