Yes it can if, as is so often the case, it is wrong. There is no requirement in the regs to follow manufacturers instructions.

How would people fitting this outside the UK fare where FCUs are not available or complaint?

Have you never heard of a double pole switch?
 
In your opinion. Common sense clearly shows overloading a circuit by over 100% is bad practice.
It's impossible to overload a correctly designed and installed circuit, even if it contains devices of a higher rating.
