Once it's decided there are grounds for arrest, which is then a referral to the Procurator Fiscal.

PC plod isn't going to arrest someone on his/her say so, this will be through a complaint to the "police".

So if there are no convictions in the next 12 months the legislator in Scotland will withdraw the legislation? Or then this is a **** show at best and lets hope most sensible people walk away from it as quickly as they can. Unfortunately I fear not.

You really think it will be a PC who decides? I'm not saying it won't all go wrong, but give it a chance. There isn't that much of a difference to existing legislation.
Sec 3 and 4 are quite significant. Not to mention the whole point is to define factors that result in harsher sentencing. What other laws do we have where a person’s beliefs result in increased sentences?

So hypothetically speaking if a person traveled from (let's just say essex as an example) to Scotland and he/him/whatever proclaimed that 'a man being with another man' is abnormal, should he/him/whatever be prosecuted?
