Hi


Lady as water coming through the ceiling from the flat above. And she knows the owners are away. Like to help but don't want a criminal record.
Whats the procedure required to gain entry?

Phone the Police or fire brigade, unless there's a landlord with a key
 
and meanwhile start reading the Household Insurance Policy and send for a carpet catalogue.

more modern flats (round here anyway) have individual stop-cocks under the pavement.

Follow DIA's advice, get the police there before you attempt anything:cool:
 
The police and fire brigade have right of entry under common law to protect property but then so have you if you can prove your intention was to protect/save property from damage.
No court in the land would prosecute you with the right intent in mind if your access was resonable ie your not knocking down a wall for a weeping joint.

Be careful of this, implied consent may not apply if you dont take all reasonable steps before doing the door ie ask the police to be present and ensure that the property is secured after you leave.

If you do the door without the above you may find yourself in trouble if someone popped in there later and helped themselves to the telly!

Even transco are meant to have a copper there for kicking in doors for houses with bad leaks so it is dodgy ground.

Slightly off topic but we had to do repossesions with the gasboard already had right of entry warrant . Fitter,chippy and debt officer it is amazing how easy and quick it is to break into a house and leave no trace taking 2 minutes.
Only draw back was when you got in you found out why bill had not been paid ,the body was still there with the telle on. One mate has now found 3 not a nice thing
 
Bear in mind that if you enter and stuff is reported missing, or someone goes in after you left, you could well be held liable.
Good intentions aside, it is not your problem. best thing is to let client arrange access (with help of police if need be) for you.
