No, the judge decides the actual sentence, or penalty to be paid.
Do you believe a person convicted of killing multiple babies wouldn't have been given the death penalty where capital punishment is available?

Posthumous 'doubts' mean nothing if the sentence has already been carried out!
 
Having life support removed and not dying immediately suggests he’s able to breathe. So you are looking at death from dehydration/organ failure

Sadly they will be giving him palliative care so he’s probably off, whatever is left of his face, on the good stuff.
I thought he was dead?
 
Judges have a level of discretion!

They didn't last time we had the death sentence for murder. Maybe things have changed since with human rights etc. It would be an interesting debate about how to frame a modern death penalty law.
