I agree it would be hard to fine you but if this is private land they should put a sign up saying clamping is in operation and CLAMP the idiots/morons/carp drivers who park in two bays and hit them with a £300 release fine..that will stop the fools.

Another one that never reads posts. The situation you describe is what we already have, and its illegal.

ill say again - you can only be bound by contract law on private land, and its illegal to impose a penalty for breach of contract, see the Unfair Contract Terms Act 1977, Consumer Protection from Unfair Trading Regulations 2008 and Unfair Terms in Consumer Contracts Regulations 1999.

All you are legally entitled to do is sue for actual losses incurred. And when it comes to clamping and ticketing , the clampers and landowners suffer no provable actual damages. I and everyoen else would have no problem recovering my £300 for your illegal release fee.

Its an illegal fee, people recover by suing under any of the three laws quoted above. Really, we do it all the time, theres no legal defence to it..............

suggest you go spend some time reading www.pepipoo.com, where theres hundreds of real life cases won against clampers, private parking companies and councils for illegal fees and tickets, and dodgy speeding tickets.
 
You may well get your money back but it wont be easy.

A guy my wife went to school with is now extremely wealthy due to clamping and towing. He was one of the first to bring it to the UK and in teh early days used thick as 5hite guys that were willing to fight anyone now, he uses your average traffic warden type.
He has contracts with the major airports and local authorities to clamp and or tow away . Getting your money back from him would be no easy task ;)
 
i hate anybody who is arrogant and selfish enough to park in 2 spaces to stop anyone parking next to their precious car, yes its annoying when your car gets dinked, but i have never been so selfish as to park in 2 spaces and would happily torch someones car who parks in a disabled space that they shouldnt, even with a blue badge for one of their passengers does not give them the right to park in a disabled space when that passenger is not with them, and they should know better
 
With a properly prepared case, its easy, clampers dont have a leg to stand on, legally. Go read the Pepipoo site, link above. The only reason hes got wealthy is because people are ignorant of there rights and the law, and pay up with a whimper and never bother challenging him.

I have a 800w petrol generator in the boot of my car for various reasons, and an angle grinder. If anyone dares clamp me on private land I shall exercise my legal right of self help from being illegally and wrongly clamped and cut it off. Then ill see the guy in court if he wants to make a fuss, and ill win, make no mistake, because im 110% sure of my legal rights from much advice from people who know, proven in real life cases.

wouldn't stop me, i would just carry a petrol grinder. :evil:

so in a car park of 500 spaces of which 200 are in use and i use two instead of one you have a problem with that?

you seem to have a problem with my "precious" car, are you a door basher?
 
sometimes you're forced over the white line because the car next to you has parked so close to their white line that parking between yours makes it impossible to get out one side..
there ought to be white lines for the bay, then a 2 foot wide hashed section between the bays so you can open the car doors...

if you use an angle grinder on a clamp then the clamper has the legal right to take you to court for the cost of replacing / repairing the damaged clamp and may be able to claim for lost income while the clamp is being repaired / replaced
They can likely have you arrested for willfull destruction of property too.

No, incorrect. There is a legal principle of 'self help' - you are entitled to remove the clamp by whatever means if you genuinely believe you have been wrongly or illegally clamped, since it constitutes trespass to goods and chattels.. Of course, if you remove a council or police clamp you wil be in the poo, but a private clamp is fair game. For example, if you have been clamped on private land with inadequate signage, or within minutes of arriving. They most certainly couldn't claim for loss of income, as they have no way to prove how many people they may clamp legally in the future, and they can hardly claim for lost revenue from illegal clamping.

Furthermore, if you get the car removed to your own private land first, you can deny them access to your car while you remove it at your leisure. You can also then charge them storage for the removed clamp.

One acquaintance of mine had a removed clamp taken all round the country for 3 months and photos of it in front of various landmarks sent back to the clampers.......................

Believe me, i have many years experience in this field, and i know the law............you just need to have the balls to stand up for your rights.

i have tried the pepi site and it is hopeless! looked through every section, tried getting advice by the link (that doesn't work)
got any other advice on speed tickets and their misuse by non signage of speed limits?
 
The mother and child bays should be at the very back of the car park. Also the mothers will be grumpy about the fact, and more likely to "properly" discipline their kids.

One day when you grow up you may have children yourself.

You have an awful lot to learn my friend, before you make statements like these.

The sleep deprivation alone is enough to warrant you being wheel-chaired in and out the store, let alone having to lug the sprogs around and the shopping.
