One thing that's been missed by everyone is that whilst the driver was receiving a fine for £85 for parking in the space for too long, it's possible he was spending £200 in one of the shops.

Exactly. Most out-of-town car parks in my experience are free and consequently attract the motoring public. That's why supermarkets are causing many town-centre shops to go out of business.

Now if local councils weren't so short-sighted and greedy, they might consider providing free car parks in town centres (or within a close distance) to attract customers back.

Completely agree. The mayor of Bristol is systematically destroying local City trade because he's hell bent on 20mph zones, parking schemes that nobody wants, the highest parking charges in the UK apart from London, etc. They spent millions on special meters just to prevent people passing parking tickets on to other motorists to use up what was left. As if giving somebody 15 minutes of parking was breaking the bank. The result; small traders go out of business and no inward investment. Still, at least the mayor can ride his bike to work. (on nice sunny days of course)

If things continue along these lines, it is quite likely that Bristol (and no doubt some other cities) will eventually become a ghost town. No shops, no places of entertainment. If people have the choice of catching the bus into town or driving to a shopping centre out of town, I suspect most would choose the latter. It is even possible that offices might re-locate to out of town sites in order to provide parking for their staff.

I wonder whether the council offices will one day remain the only occupied buildings in Bristol!
 
I completely agree JBR. If I drive over to Lakeside or Bluewater shopping centres, I can park all day for free. So once I have bought the things I have gone for, I can then browse around spending more money, perhaps a coffee or two and something to eat. I could even see a film if I wanted to.

If I go to my local High Street and I eventually find a parking space, I tend to rush around getting what I need, then straight back to the car. Even if I just needed a newspaper or visit the post office I would need to pay £1 for the privilege.

Obviously I prefer going to the shopping centres for a more relaxing time but the High Street is slowing dying. Car parks that used to be free have been taken over by supermarkets.

Not sure he will though unless somebody (the RAC?) funds him. The problem is that this type of penalty charge isn't a new thing in contract law, they've been around for years. Liquidated damages is easy when there is a clear loss but not so easy when the loss is not easily quantifiable or - as in this case - the quantifiable loss would be insufficient. There is no charge for parking so the loss is zero. So what's to stop people parking all day long? Case law determined years ago that where a situation doesn't fit into standard contract law a 'reasonable' penalty may be justifiable for commercial reasons. There are lots of cases where this has been allowed. As I said before, the only alternative is to charge for parking which penalises everybody.
