NEIGHBOURS MOVED GUTTER DRAIN

Hi, my neighbour is having an extension done. We have a semi detached property with shared guttering. The down pipe from the guttering used to go straight down in to my neighbours garden in to the gutter drain which was in their garden. They are now extending the house where the gutter drain is so they have moved the drain on to our side so the down pipe now turns in to my garden. Is my neighbour allowed to so this?

OK if I have this correct?? Pre-neighbours extension a [common] rain water down pipe was sited so that the discharge was in your neighbours garden, into an underground drainage system??

During the neighbours building of their extension, this [common] rain water down pipe has been "moved" ?? so the rain water from both roofs now discharges directly into your property and not into an underground drainage system.

so the shared downpipe was slightly on my neighbours side of the garden and went straight down in to the drain which was in my neighbours garden. They have now dug up and moved the drain so its on my side and the down pipe now goes down but they put like a bend in the pipe which turns and runs in to the new drain on my side. So now if I wanted to extend my house to the length of theirs, there is a drain in the middle of where the boundary wall would be.

i hope that makes a bit more sense.
 
Was there any discussion about this move of the drain? before your neighbour commenced work?

Now this is where I duck out and let those who know about such [English] Party Wall [crap] sorry Act?

Were you not aware of them digging a drain on your property?

no I wasnt as all they had done was dug the foundations. I dis think it was strange as they had dug them quite qide on to my side. But when returning from work they had already moved the drain and changed the angle of the downpipe.

I just want to know what my options are and if they are allowed to do this without my permission.

I'm no legal expert either, but think it would require your permission unless some covenant relating to drainage of the properties allowed it. Have you checked your property deeds?

Sorry,really not being "picky" but? did the neighbour encroach on your property with the founds they have layed?

As an aside, is the boundary clearly delineated ?

Thank god we do not have such a [money spinning] system up here??
 
Iv'e seen a lot worse! at least they seem to be doing it correctly albeit they should have made you aware of what they were going to do first. I wouldn't worry.
