Am I the employer? Or the Customer? (Joe90)

As has been said by others the term employed does not apply in this case , the customer is contracting you !!

If for example you used a fixed loft ladder & it fell apart causing injury than they might be liable ?? i assume there would be a duty of care on any house holder who invites some one into there house , as a tradesman ect you are in most cases only there by invitation !

If you actually believe what you're stating then I can only summise that you choose to view anyone you pay as in your employ to big yourself up in life, when in reality you've never employed anyone.

Nope.

If you buy a stamp in a post office, or a newspaper in a shop, or buy a service from a car mender or a window cleaner or an electrician, you are not the employer of the person who sells you those goods or services. You are the customer which is not the same thing.

However if you employ a cleaner who works exclusively for you (not someone who has a number of clients) then how are you facing up to your responsibilities for tax, NI, pension, holidays and sick pay?

Nope. In the eyes of the law the guy at the door is my employee. As my employee I must make sure that I observe a 'duty of care' towards him. If I don't - then as my employee he can sue me.
Well add me to the no- nowt about servicing :lol: . Are you a poet - in the eyes of the law the guy @ the door :roll: Who is which side of the door :?: . This plumbing forum gets worse . Talk about start a fight in an empty room . some would kick the door down first - and they`d be inside the room :mrgreen:
 
I left a ladder in a house where I doing some work. The builder there had some Polish decorators.

As all boiler engineers know, if you leave any tools or ladders where the Polish are working, you can expect to find them using your stuff.

What amused me was that Mr Painterski was standing on my ladder with the words showing:-

Do not climb on this side!
 
Whether I employ someone for an hour, a day or a year - in the eyes of the law I am, during that time, his employer. If I go into a shop I offer to enter a contract (law of torts) I do NOT employ the shop keeper. However, if I pay a gardener to cut my lawn or a cleaner to clean my floor or a gas fitter to service my boiler - then like it or not - I EMPLOY him.
 
For the time I employ them I am. You are getting there. :wink:
