If someone overstays a 2-hour limit in an out-of-town retail park by a few minutes, it could be argued that £85 is unreasonable.

Exactly, judges are paid far too much these days. No wonder they're out of touch with the ordinary working man.
Not as if anyone's going to ticket M'lud's DS420, anyway.
A friend of mine got stung for £60 for being late by under 10 mins. He's appealing, naturally since he apparently found some clause somewhere that states the the overdue fee should be in accordance with the loss of earnings of the provider. This would amount to less than £1 for the 10 minute period. I'll ask him for the link and how his claim is getting on in due course

The point of a two-hour limit space is that it provides a service for motorists, to carry out reasonable tasks and errands within that time period.
IMO, it is entirely fair that the fine reflects the loss of utility to other motorists, and therefore acts as a deterrent to potential selfishness on the miscreant's part.
If the council have limited the parkable time inappropriately, this is a separate issue.
It is not comparable to someone overstaying by an hour (when they've paid-and-displayed for two), in a multi-storey carpark that is open for 16 hours per day.
I've got mixed feelings over this. Firstly, what was the bloke doing for nearly three hours? He obviously wasn't shopping for that time so I assume he was just taking advantage of the free parking. He didn't dispute the parking signs were visible and clear, nor the charge for staying longer than 2 hours. In other words he knew what he was getting into. And the initial charge was £85 but reduced to £50 for payment in 14 days. So we are really talking about a fifty quid charge here. The mixed feeling is that the charge is obviously a penalty and not a pre-estimate of loss. But then what are you supposed to do if people take the plss out of what is a fairly reasonable deal - i.e. free parking for 2 hours? Charging them a quid doesn't work, so if you can't set a charge that is a deterrent the car park would just be constantly full of people who park there and plss off elsewhere. Where would that leave people who want to just park - for free - shop and leave? What will happen is we'll all end up having to pay to park because of this selfish little git. (big git actually - too many fish lots.)

I also have mixed feelings on this. Generally, I hate parking charges and truly believe that all traffic wardens should rot in hell but this guy did take the p*SS. What bothers me is this: If he had out-stayed his welcome by just a few minutes, would the fine still have been for the same amount?
