Scammed by ebay or by seller or by both ?

I bought some duracell batteries from a seller called 'greatukdealsltd'.

Waited and the item didn't come (either stolen or lost in the post).

I put in a request through the resolution centre as follows:

Here's the log :

Me : Jan 25th : I haven't recieved these ?

Me : Feb 2nd : Can you give me a response please? I never recieved these batteries

and then ...

From ebay : Your request was closed because we didn't hear from you. If you have a request open for 30 days and we don't hear from you, we'll close the request.

So they closed the case and didn't refund me the mone.

Not really a big loss but not a nice feeling continuing to use a service that just scammed you.. luckily it was only a few quid and not a more expensive item.

This only became apparent to me when I was looking through my account.

p.s. I notice the user is no longer registered on ebay. So I do wonder if they have done this to loads of other people shortly before pulling their business.

I think paypal you have to escalate it to a claim within a set period of time. Did you do that? If you did then you should've won and got your money back.
 
you could send them a letter before action:

blighty, just got off the phone and they agreed to refund straight away. I brought to their attention greatdealsuk profile on ebay and he said yes that's fraud straight away. I didn't ask whether they had already been contacted but there's months of feedback on there from mostly people saying they paid for items that were not delivered.

Cleverly, whoever it was sent out the occasional item once in a while to make it look like just poor customer service and not all out fraud in order to confuse ebay customer service who I've always found have been total sh1t, so they clearly knew what they were doing. Anyway, paypal were brilliant and agreed to refund straight away. Feel sorry for those that don't think to do this though. There's quite a few grand there if you total it all up and the strange thing is their paypal trading account is still open even if the ebay one was closed so you can still get back the money anyway.

Strange really as their feedback rating was not altogether that bad for the first few years of trading, but then they seemed to get into the habit of de-frauding people and getting more and more greedy. Can only guess they got sick of trading on ebay but why not pull the business and move on, why take it out on the customer? Anyway, result.

p.s first time I've ever been scammed on ebay that I can remember. And sad I blamed royal mail for non-delivery and thought it must have been nicked or stolen by someone working there or a neighbour.

didn't think so but took the 5mins writing the e-mail and sent it. You reckon they'll do completely fuk all ?
 
I got caught last year. Bought an sm58 mic from fleabay. Time I used it months later it was obviously a fake. Traced it back to abdul summit or other, no longer trading. Too late to go back to fleabay or paypal. Hey ho!
 
it depends if there is evidence of fraud. accepting and not fulfilling orders isn't enough.
 
lots of fake iphones on ebay. You can get a working "iphone 7 plus" for £100 or less
 
The term fake is a fraudulent term in itself though because although some batteries are not OEM they are not exactly 'fake'. Fake implies it's a completely dud product, which most of the time it isn't, it's just manufactured somewhere else with probably a shorter shelf life. Although for a lot of things OEM don't last any longer and doesn't justify the premium they come at. Don't forget the reason there are non-OEM products is because OEM products are so bloody expensive. If they cared that much they would lower their goddamm prices to price out non-OEM competition.
 
OEM = Original Equipment Manufacturer

OEM companies make components that are included in the brand name manufacturer's products.

Some OEM companies sell their products only to other manufacturers for use in their products.

In almost all cases the OEM's are under pressure to sell to the manufacturer at the OEM's lowest possible price.
