Katie Hopkins

I notice Motorbiking avoids dealing with the fact Katie Hopkins had been tweeting about Laurie Penny numerous times beforehand, so it is inconceivable she would suddenly mistake her for somebody else.

Let’s see Motorbiking try and wriggle and squirm out of that

Therefore Pete's analysis was 100% accurate
Petals “analysis” was that he claimed the case was about “mistaken identity”

It was not, the case had nothing to do with it.

The so called “mistaken identity” was used by Katie Hopkins” as a reason for the tweet, it was an attempt by her to get herself off the hook without apologising, because she is a poisonous right wing shill who thrives on stirring up hate and division.

This is nothing more than your opinion.

it was. The claimant agreed, the defendant agreed, the lawyers agreed, the judge agreed. But a builder, a part time mechanic and a Joiner(?), say otherwise and look like fools... again.

Katie Hopkins had been previously tweeting about Laurie Penny.

That’s fact, not opinion

The claimant agreed, the defendant agreed, the lawyers agreed, the judge agreed
No they didn’t, none of them ‘agreed’

Agreed meaning: “discussed or negotiated and then accepted by all parties.”

None of that took place, it was neither discussed nor negotiated by any party.

If you want to claim it was ‘agreed’ you need to show the evidence of discussion or negotiation……but you won’t be able to because it was immaterial to the case.

I am sorry you keep being wrong, how embarrassing for you.

Katie Hopkins reminds me of Matthew Hopkins witchfinder general -film for looks

Let's try and keep it really simple for you.

If KH had apologised, would she have been taken to court ?

This is what she asked for:

The letter requested a correction and apology, an undertaking not to repeat this or similar tweets about Ms Monroe, payment of a “substantial donation” to a charity of Ms Monroe’s choice, and payment of legal costs. The form of correction and apology Ms Monroe wanted was spelled out: “A tweet to be sent at a date and time to be agreed, ‘I was confused about identity. I got it wrong. @MsJackMonroe I’m sorry. I have made a substantial donation to charity at her request.’”

Mentioned in the letter before action and more than half a dozen times in the judgement.

In legal disputes where time is money, you focus on what is not agreed, not what is agreed.

Common ground is not discussed, because it’s a waste of time and around £1500 p/h.

Hopkins sold her Exeter home in March 2018 to pay the debts arising from the case,[9][10][11] and applied for an individual voluntary arrangement in May.[3] Monroe said of the news: "My offer of a cup of tea still stands if she wants to talk about it ... Lots of people are celebrating but I’m not. It's a sad, lonely sort of anticlimax. It’s really crap and I feel really bad it’s all ended up like this. I thought she'd just say sorry."

No.....

Jack Monroe, a food writer and activist, sued columnist Katie Hopkins for libel in 2017. The case arose after Hopkins falsely accused Monroe on Twitter of vandalizing a war memorial or condoning such behavior. Hopkins had mistaken Monroe for another writer, Laurie Penny, who had commented on the vandalism of a memorial during an anti-austerity protest. Monroe requested an apology and a donation to charity, but Hopkins refused, leading to the lawsuit.

Eh? Explain.

Eh? Explain.
Imagine it was you and I and our identities were known. Assume you defame me and I demand an apology and donation to the Reform Party of £5k. It is intended to humiliate you, as it’s well known that you cannot stand their cause. I then crow about how much fun I’m going to have owning you. Etc blah blah. It is not a genuine offer for a financial settlement. Of course I can ask you to pay me and I can suggest I will donate the money. That is entirely different. Then after your partial compliance, I then retract the offer and sue for damages.

No doubt you will suggest the above is irrelevant nonsense.
