If the Tony Martin case happened today...

Don't know if he would still get off, shooting someone with an illegally owned shotgun should still have consequences even if it is claimed it is in self defence.
 
He'd have got bugger all if he'd claimed to have been terrified and alone, when they broke in.
Instead, he was belligerent, and said that they deserved it and he'd do it again. If I recall correctly.
 
He should've got off scott free.. If you're in your own house minding your own business and someone breaks in to steal your belongings with no regard or respect for you, your health, you could have children there. You should be able to do anything to remove the threat.

In this situation, normal rules of society and how to conduct yourself goes out of the window. The intruder has set up a whole new ball game where you don't know the rules or how far they will go to achieve their goal. Therefore, deadly force is appropriate and should be acceptable.

However, the defence need to show without reasonable doubt that the victim had no right to be there... shooting your missus on the lav because you thought she might have been a murderous attacker aint good enough !!
 
He would probably be charged with illegal possession of a firearm, and
maybe manslaughter, but who knows. There aren’t enough police to respond to rural crime, so prosecutors would probably take that into account.

I've just had a quick search. Joe90 seemed to be on the other side of the debate. He seemed to be pretty right wing and MrsTenNames etc. always seems left wing.
