is a council/housing assn allowed to disconnect the gas at an external meter enclosure,if the tenant has not allowed the annual gas safety inspection due to being out.not getting appointment letter,school run,working,in hospital etc.
i thought it was only the supplier of gas or electric is allowed to disconnect their services.
maybe i am just old fashioned.

Don't know about that one, but a legal requirement they DO have is to provide a method of heating and cooking. Cutting off the gas seems to take away those.

HA's are within their rights to disconnect for safety reasons, not being in for an annual service falls within that, for most it is the end of a very very long road after they have exhauseted evry avenue to gain access, i dont think it is a case of two visits then gas off, so tenant who has this done has not tried a leg to let them in, most HA's make 3 appointments with opportunity to change them all before they take action, so i'm sorry i have no sympathy for someone who cannot rearrange something or leave a key to get a free safety check done, i never ceases to amaze me that people get at least 3 cards through their door and do nothing about it then bleat when action is taken, remember the HA has a duty to protect not only these idiots from themselves but neighbours and themselves from litigation. there was a case in Newcastle crown court a few years aago where a tenant like this successfully sued the local council/HA for neglect of duty because the service wasnt done within time, he admitted in court he had numerous cards, recorded visits etc but as he had lifestyle problems he was never available to let them in, but he argued that by not forcing the door and turning the gas off put him in danger, only in Britain would he win, but he got £800 comp.

quite a few HA's fit programmer/timers to the boilers that start shutting down slowly, ie reduced hours of operation after 365 days. The tennant has no choice but call to allow someone to do a re-set and inspection.

Worked with HA for a year and they were taking there tenants to court for not letting them do the safety checks

I thought that the "school run" was only a feature of up market private housing and not council/housing ass etc.

My daughter goes to school on the bus like most of the other kids at her school ! I walked ! It was only about one mile !

There is a simple solution for you!

Engage a private gas engineer to turn the gas supply back on and do the certificate for you. We only charge £65 in our area and would often come at a weekend for someone without gas.

Since when has the school run become class distinctive

Many of my customers, whether they walk young children to school, see them safely onto a school bus, or as you seem to imply, take their kids to school in a brand new Range Rover, all have to cope with the 'school run' twice a day, or if they have younger kids as well, maybe more than twice.

I however, always try to fit in around their committments, rather than be obnoxious and awkward about things

At the local nursery school, every afternoon when they virtually block the road for 30 minutes, they all seem to be vying to have the latest and largest new space waggon or 4 x 4 to collect their one or two kids.

A little Ford Ka would take up less space, be much cheaper to buy and run and far more practical in London.

Since a bus runs past the door, they could do the "school run" on the bus and save the global warming. Would not be able to show off their latest new motor then though.

Where my daughter goes, an all glass and computers on every desk new academy, they have actually designed the road outside to be single lane with no ability to stop outside to pick up.

Any parent in a car has to find a side road over 300m plus away to stop in. They dont seem to be many being collected by car! They also have a dedicated bus route to serve the school in/out times.

Not only are they allowed, it could be argued that they are negligent if they don't.
It is a indisputable legal requirement for the landlord to have an up to date landlord certificate. Failure to have one in itself, even if the gasinstallation is absolutely perfect, is a £5000 fine if prosecuted.

Unfortunately for those tenants that are different, a large number of tenants couldn't care less about the work that needs doing and don't even bother moving the appointment.

It does happen that a letter gets lost, but when you consider that it can cost £5000 per address if the inspection is not done, you can work out what the chances are the letter was not sent.

I have never heard of anyone being cut off before a second attempt is made, and calling card is left. Those that find themselves without gas are either extremely unlucky, or in 99% of cases were asking for it.
